Lawsuit Alleges Wells Fargo Deceptive Mortgage Modification Practices

Deceptive mortgage modification practices have led to a lawsuit against a division of Wells Fargo.

America's Servicing Company, a division of Wells Fargo Bank NA, is named in a lawsuit charging the company with improperly and unlawfully inducing borrowers to default on their mortgages. The lawsuit, filed in the United States District Court for the Northern District of California, claims that Wells Fargo informed borrowers that mortgage modifications would not be considered for those individuals who were current on their payments.

America's Servicing Company is accused of unnecessarily subjecting borrowers to ruined credit by making mortgage default a requirement for modification.The bank failed to examine mortgages for modification if they did not meet this requirement, regardless of whether an individual was otherwise qualified for a modification. The lawsuit contends that these practices subjected borrowers to unnecessary and substantial fees, penalties and interest.
